Acting at the request of the 10th U.S. Circuit Court of Appeals, the state high court ruled on Tuesday that Oklahoma law does not and never has allowed birth certificates’ sex designation to be changed.
The 6-3 decision undercuts the arguments of three transgender Oklahomans — two from Tulsa and one from Creek County — whose 2021 court orders to effect such changes were denied by the Oklahoma State Department of Health at the direction of Gov. Kevin Stitt.
