Attached to this order is an appendix that identifies 96 court orders that ICE has violated in 74 cases. The extent of ICE’s noncompliance is almost certainly understated. This list is confined to orders issued since January 1, 2026, and the list was hurriedly compiled by extraordinarily busy judges. Undoubtedly, mistakes were made, and orders that should have appeared on this list were omitted.
This list should give pause to anyone - no matter hist or her political beliefs - who cares about the rule of law. ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence.
What are we going to do about it?
Violent resistance has my vote.
Laws are a social contract, an agreement between the governed and the government that we will follow the laws as long as they provide justice. If the government turns to tyranny and fascism, they have broken the contract and their laws are no longer valid. Justice is a concept that can only exist where there is a balance of power. If one side has unchecked authority to violate any law, then the concept of justice has been nullified and the powerful simply take whatever they want. But the tyrant and the fascist always make the same mistake, because they always forget that they are not the powerful ones. They are dramatically outnumbered. An oligarchy can get away with a great many things as long as the people believe that justice exists. But once that illusion is shattered, they lose the protection of civility and the people invariably take back what belongs to them.
No justice, no peace.
