The United States doesn’t recognize the ICC, precisely for the purpose of committing crimes if they want to. And the United States has committed, and still commits, plenty of crimes.
The Invade the Hague Act is still on the books from the Bush era. If the ICC convicts any American, the military will invade Europe and attack the Hague.
